Terms of Service

1. Acceptance of Terms

By accessing or using the Sequim Lavender mobile application and website (collectively, the "Service"), operated by the Sequim Lavender Growers Association ("SLGA," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

The Service provides information about lavender farms in the Sequim, Washington area, the annual Sequim Lavender Festival, educational content about lavender, a digital farm passport feature, event listings, and trip planning tools. The Service is provided free of charge to users.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to transmit harmful, offensive, or inappropriate content
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems to access the Service without our permission

4. User Content

The Service may allow you to submit photos, survey responses, and other content. By submitting content, you grant SLGA a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with the Service. You represent that you own or have the necessary rights to submit such content.

5. Digital Passport

The Digital Lavender Passport feature allows you to track farm visits by scanning QR codes. Passport data is stored on your device and optionally synced to our servers. Passport achievements and badges are for personal enjoyment and do not carry monetary value or guarantee any benefits from individual farms.

6. Farm Information Accuracy

While we strive to keep farm information, hours, and event details accurate and up-to-date, we cannot guarantee the accuracy of all information at all times. Farm hours, availability, and offerings may change without notice. We recommend contacting individual farms directly to confirm details before visiting.

7. Location Services

The Service may use your device's location to provide directions to farms and show nearby points of interest. Location data is used only while you are actively using the Service and is not stored or shared with third parties. You can disable location services at any time through your device settings.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by the Sequim Lavender Growers Association and are protected by copyright, trademark, and other intellectual property laws. The SLGA name, logo, and associated branding are trademarks of the Sequim Lavender Growers Association.

9. Third-Party Links

The Service may contain links to third-party websites or services, including individual farm websites and social media pages. We are not responsible for the content, privacy policies, or practices of any third-party sites or services.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. SLGA does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by law, SLGA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Clallam County, Washington.
